Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. INTERNET ACCESS AND A VALID E-MAIL ADDRESS ARE REQUIRED TO ENTER THE PROMOTION

HOW TO ENTER: To enter Smucker's Ice Cream Toppings "How Do You Cover Your Vanilla?" Promotion, go to www.YourVanillaIsShowing.com between May 17, 2009 at 12:00 a.m. Central Time (CT) and September 5, 2009 at 11:59 p.m. CT ("Promotion Period") and follow the on-screen instructions to register for the Promotion and to create your own way to cover your vanilla. Limit one entry per person or e-mail address per week of the Promotion Period. No robotic, programmed, script, macro or other automated entries. Multiple entries in a weekly drawing period, including multiple entries by the same entrant using different email addresses, will invalidate all entries submitted by that entrant for the weekly drawing period.

ELIGIBILITY: The Promotion is open to legal residents of the 50 United States and D.C., 18 years of age or older, except employees of The J.M. Smucker Company ("Sponsor"), its affiliates, subsidiaries, sales representatives, advertising, sales promotion and judging agencies and all other service agencies involved with the Promotion, and members of the immediate families (parent child, sibling and spouse) or households of each. Void outside the 50 United States and D.C. and where prohibited.

WEEKLY DRAWINGS: To be eligible for a Weekly Drawing, an eligible entry must be received and recorded by Sponsor's computer that week (each Sunday at 12:00 a.m. CT to the following Saturday at 11:59 p.m.) during the Promotion Period. Drawings for each week will take place on or about the following business week. Non-winning entries will not be entered into subsequent Weekly Drawings.

GRAND PRIZE DRAWING: One Grand Prize will be awarded in a random drawing conducted on or about September 9, 2009 from all eligible entries submitted over the entire Promotion Period.

WEEKLY PRIZES/ODDS OF WINNING: 16 Weekly Prizes: one Ice Cream Sundae Gift Basket, including assorted Smucker's Ice Cream Toppings and sundae-making items. Approximate retail value ("ARV"): $25.00 each. Limit one Weekly Prize per person or household. Odds of winning a Weekly Prize depend on the total number of eligible entries received for each Weekly Drawing.

GRAND PRIZE/ODDS OF WINNING: A $500 Grocery Shopping Spree awarded in the form of a check. Odds of winning depend on the number of entries received. Total ARV of all prizes: $900.00.

GENERAL TERMS & CONDITIONS: By entering, entrants agree to abide by and be bound by the Official Rules, Sponsor's privacy policy, site usage terms, and by the decisions of the judges, which shall be final and binding in all matters relating to the Promotion. Weekly prize winners will be notified by email and prizes will be shipped to the address provided in the entry within 6 weeks of the end of the Promotion. Grand Prize winner will be notified by overnight delivery. Prizes are non-transferable. No cash redemptions or substitutions permitted, except by Sponsor, who may, in its sole discretion, substitute a prize, or any portion thereof, of equal or greater value. All taxes on prizes are the sole responsibility of each winner. By entering the Promotion, entrants agree that neither the Sponsor nor its affiliates or subsidiaries, nor any of their respective shareholders, directors, officers, employees, sales representatives or agencies including, but not limited to, Promotion Activators, Inc., will have any liability whatsoever for any injuries, losses, harm, damage, cost, or expense, including, without limitation, any personal injury, arising from or in connection with participation in the Promotion, or the acceptance, possession or use of prize or participation in any prize related activity. Acceptance of prize further constitutes consent of winner for Sponsor's use of winner's name, likeness and/or prize and biographical information in all media worldwide without limitation for advertising or promotional purposes without further compensation, except where prohibited. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes in a random drawing from among the eligible entries received up to the time of the impairment or take such other action deemed fair and equitable by Sponsor. Sponsor reserves the right to award only the number of prizes stated in these Official Rules. No more than the number of prizes stated in these Official Rules will be awarded. If due to a production or other error, more prize winners are identified than are intended to be awarded at any prize level as stated in these Official Rules, such prizes will be awarded in a random drawing from all such verified prize claims received for such prize level. All entries and requests become property of Sponsor. By entering, entrants (and entrant's parent/legal guardian if entrant is a minor) agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts in Cleveland, Ohio.

LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e mail address submitted at the time of entry. "Authorized account holder" is deemed as the natural person who is assigned to an e mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e mail addresses for the domain associated with the submitted e mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Promotion or Website, may be acting in violation of the terms of the Website or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of the Promotion is unlawful and subject to legal action by Sponsor or its agents.

IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT'S ACCESS TO AND USE OF THE PROMOTION INTERNET SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
