SPREADING SMUCKER'S® TRADITIONS RECIPE AND ESSAY CONTEST OFFICIAL RULES
Spreading Smucker's® Traditions Recipe and Essay Contest ("Contest") begins on August 26, 2009 at 12:00 a.m. Eastern Time (ET) and ends on October 12, 2009 at 11:59 p.m. (ET) ("Contest Period").
HOW TO ENTER: Two ways to enter: 1) Online - Visit the Smucker's Web Site (www.smuckers.com) during the Contest Period to access the "Contest Entry Form." Complete Contest Entry Form, including your family's original recipe made with at least 1/4 cup of one of Smucker's jam, jelly, preserves, fruit spread, or fruit butter that must have been passed down for at least two generations (as hereafter defined). In addition, you must submit an original essay of 200 words or less (in English) telling the true story behind, or memories associated with, how your recipe makes family celebrations special. You must also include the names of the family members from the generations involved in passing the recipe down and their relationship to you. To submit your entry, you must agree to these Official Rules and then click "Submit Entry." 2) By Mail - download and complete a Contest Entry Form available at www.smuckers.com, or hand-print or type your name, date of birth, complete address, daytime and evening phone numbers, e-mail address (if applicable), your family's original recipe made with at least 1/4 cup of one of Smucker's jam, jelly, preserves, fruit spread, or fruit butter that must have been passed down for at least two generations (as hereafter defined). In addition, you must submit an original essay of 200 words or less (in English) telling the true story behind, or memories associated with, how your recipe makes family celebrations special. You must also include the names of the family members from the generations involved in passing the recipe down and their relationship to you. To submit your entry by Mail, send all of the above (as applicable) in a standard, business-size envelope to: Spreading Smucker's Traditions Recipe and Essay Contest, C/O Cohn & Wolfe, 292 Madison Avenue, Floor 4, New York, NY 10017. Entries must be postmarked by October 12, 2009 and received by October 21, 2009. Limit one entry per person/e-mail address, regardless of method of entry. Multiple entries will invalidate all entries from the entrant. All entries, including the recipe and essay submitted, become the property of The J.M. Smucker Company ("Sponsor") and none will be returned.
RECIPE DETAILS: The Contest recipe entry must be an original work that was created by the extended family of the adult entering the Contest and cannot have previously won a contest or other promotion. Recipe and essay entries must not have been previously published, must not be awaiting publication, nor may be submitted for publication consideration during the period of the Contest. The original recipe must have been passed down for at least two generations. "Generation" is defined as: the related individuals, constituting a single step in the line of descent from an ancestor (e.g. mother to daughter represents one generation and grandmother to mother to daughter represents two generations). Recipes must list all ingredients in exact common U.S. household measurements in order of use, step-by-step preparation instructions, cooking times and number of servings. Recipes containing alcohol will NOT be considered. Recipe must include at least 1/4 cup of Smucker's jam, jelly, preserves, fruit spread, or fruit butter as an ingredient. If your family's original recipe uses jam, jelly, preserves, fruit spread, or fruit butter, but does not mention Smucker's brand, you are permitted to update the original recipe with any Smucker's jam, jelly, preserves, fruit spread, or fruit butter variety, including traditional, Low Sugar™, Organic, Simply Fruit®, Orchard's Finest®, Squeeze and Sugar Free products. The flavor or variety of the Smucker's product used in the recipe must be specified. Recipes may not include any other brand name product or the trademark of any other manufacturer, except for the Smucker's family of brands (including Smucker's, Jif®, Crisco®, Hungry Jack®, Martha White®, Pillsbury® (baking mixes, frosting and flour brands), Eagle Brand®, etc.) If a recipe contains any other brand names or trademarks of any other manufacturer, Sponsor may disqualify the recipe or, at its sole discretion, substitute a generic ingredient without notice to entrant.
ELIGIBILITY: The Contest is open to legal residents of the 50 United States and D.C., 18 years of age or older. Employees, officers and directors of Sponsor, its affiliates, subsidiaries, distributors, sales representatives, Web Site developers and administrators, retailers, advertising, sales promotion and judging agencies and all other service agencies involved with the Contest, and members of the immediate families (parent, child, sibling and spouse of each) or households of any of the above are not eligible. The Contest is open only to amateur home cooks. No Professional Chefs (as hereafter defined) or students applying to or enrolled in a degree program at a cooking school may enter. "Professional Chef" is defined as any person who has received compensation as a source of income for his/her cooking. Entries from anyone who has been a prize winner in any Sponsor (including Smucker's, Jif®, Crisco®, Hungry Jack®, Martha White®, Pillsbury® (baking mixes, frosting and flour), Eagle Brand®, etc.) contest in the 12 months prior to the Contest start date will NOT be considered.
JUDGING: Initial recipe judging will be done by a qualified panel of judges based on the following criteria: likely taste, creativity, ease of preparation and nutritional balance. The top 20 recipes (including ties) will then be prepared and judged by a qualified panel of judges and assigned points based on the following criteria and point system: taste (1-50 points); creativity (1-15 points); ease of preparation (1-15 points); appearance (1-10 points); and nutritional balance (1-10 points). Essays corresponding to the top 20 recipes will be judged on the following criteria: relevance to theme (1-10 points); creative expression (1-10 points); and clarity (1-10 points). Points from recipe judging and essay judging will be combined to determine the top five finalists ("Finalists"). In the event of a tie, the entry with the higher score first in the taste category and then in the creativity category for the recipe and then the higher score in the creative expression category for the essay will determine the Finalist. If a tie continues, the tied entries will be re-judged by a new judge using the original criteria. The five potential Finalists will be chosen on or about October 23, 2009 and notified via telephone or mail. Finalists are subject to eligibility verification and cannot discuss their Finalist status with the public until notified by Sponsor or the public announcement is made. Finalists will be announced to the public on or about October 30, 2009.
ONLINE VOTING: Beginning at 12:00 a.m. ET on or about November 2, 2009 and ending on or about December 11, 2009 at 11:59 p.m. ET the top five Finalists' recipes will be posted on a Contest microsite linked to the Smucker's homepage and a public online vote will help determine a winner. Visitors to the microsite, after registering by completing the registration information, specifically, name, e-mail address, and date of birth, may vote for the best recipe based on the recipe judging criteria listed above. Limit one vote per person and per e-mail address per day (12:00 AM ET to the following 11:59 PM ET). Voters must be at least 18 years old. Use of automated, programmed or robotic means of voting or use of any other artifice by a Web site visitor to submit votes in excess of the foregoing limitation on voting or otherwise to manipulate the voting totals is strictly prohibited and any votes submitted thereby will be discounted; such conduct will also be deemed by Sponsor to constitute tampering with the Contest (as discussed below). Each Finalist's entry will be re-created by a food stylist and photographed by a professional photographer using the same lighting and background to be placed online and judged by the public. Food stylist and photographer used are at the sole discretion of the Sponsor. Each Finalist's first name and state of residence will also be displayed online with his/her entry. By entering the Contest, each entrant (and his/her parent/legal guardian) acknowledges and agrees that if his/her entry is selected as a Finalist: (a) while food stylist and professional photographer will seek to accurately re-create the food creation and Sponsor will seek to accurately display on the Web site the photograph and description of the food creation, the food creation as re-created and displayed (as well as the description of the food creation) may differ from the food creation as originally described by entrant (and his/her parent/legal guardian) due to technical limitations/malfunctions/errors/defects/modifications and Sponsor and its agencies will have no liability related thereto; and (b) Sponsor may display the photographs (and accompanying descriptions) of the Finalists' food creations in any order, pattern or format, at its sole discretion. Finalists will be judged by the general population based on the criteria above, with points being awarded to each as follows: 50 points for first place, 45 points for second place, 40 points for third place, 35 points for fourth place and 30 points for fifth place. The Finalist with the highest total combined score from the two rounds (180 total points possible consisting of up to 130 points from the initial round of judging and up to 50 points from the online judging) will be deemed the Grand Prize winner. Grand Prize winner will be determined on or about December 18, 2009.
PRIZES: ONE (1) GRAND PRIZE: Trip for eight (8) to the WALT DISNEY WORLD® Resort near Orlando, FL. Trip package includes roundtrip coach-class airfare for eight (8) between the major metropolitan city airport in the United States closest to the winner's residence (determined by Sponsor in its sole discretion) and Orlando International Airport; four (4) night stay at a WALT DISNEY WORLD® Resort hotel (three (3) standard rooms, four person maximum occupancy per room) (hotel determined by Sponsor in its sole discretion); round trip ground transfer for eight (8) between Orlando International Airport and the WALT DISNEY WORLD® Resort hotel via Disney's Magical Express service; eight (8) five-day MAGIC YOUR WAY Tickets with Park Hopper® Option; complimentary use of existing transportation within the WALT DISNEY WORLD® Resort; eight (8) Disney Family T-Shirts; and three (3) 8x10 commemorative family photos at selected theme park. Winner must complete trip between January 1, 2010 and September 30, 2010 or prize will be forfeited in its entirety. Trip accommodations and air transportation are subject to availability and other restrictions or blackout dates. No transfer or substitution of vacation elements will be permitted, except by Sponsor. Travel must be roundtrip. Airline and flight itinerary determined by Sponsor in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. If winner lives within 120 miles of the WALT DISNEY WORLD® Resort, alternate ground transportation will be provided and no compensation will be provided in lieu of airfare. Trip may not be transferred, sold, traded, or rescheduled. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, round trip ground transportation between winner's residence and the departure airport, passenger tariffs or duties, surcharges, airport fees, baggage fees, service charges or facility charges, meals, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner. Travel companions must be 18 years of age or older as of the date of departure, unless the minor is the child, grandchild or extended family member of the winner, and must travel on same itinerary and at the same time as the winner. If winner is a minor in their state of residence, at least one (1) of the travel companions must be the winner's parent or legal guardian. Travel companions must execute liability/publicity releases (except where prohibited) prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Approximate Retail Value ("ARV"): $10,976. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. Grand Prize winner will have his/her family recipe and essay posted at www.smuckers.com under the Contest microsite. FIVE FINALIST PRIZES: each Finalist will receive one Gift Basket of Smucker's brand product. Approximate Retail Value ("ARV") of Gift Basket is: $100.00 each, actual value depends on products selected. Total ARV of all prizes: $11,476. Prizes not redeemable for cash and no substitutions will be made, except by Sponsor who may substitute a prize of equal or greater value. All prizes will be awarded provided they are properly claimed in accordance with these Official Rules and a sufficient number of eligible entries are received and provided further that circumstances permit. Limit one prize per person, household, or family.
GENERAL TERMS & CONDITIONS: All potential Finalists and winner will be notified by telephone and/or certified mail. If a prize is won by an eligible minor, it may be awarded on the minor's behalf to a parent or legal guardian, who must sign any required documents. Potential Grand Prize winner (or winner's parent/legal guardian if winner is a minor) must execute and return an affidavit of eligibility and liability/publicity release (where permissible) within 14 days of receipt of notification or prize will be forfeited and an alternate winner selected on the basis of the criteria stated herein, time permitting. The winner will also need to make himself/herself available for media interviews and public relations activities related to the Contest where appropriate. By participating in the Contest, winner agrees to release, hold harmless and indemnify the Sponsor, Disney Destinations, LLC, their respective affiliates, subsidiaries and distributors and each of their respective shareholders, directors, officers, employees and agencies from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorney's fees and court costs) arising directly or indirectly from or in connection with his/her participation in the Contest, acceptance, possession or use/misuse of the prize or participation in any prize-related activity. Winner further acknowledges that the above parties are in no manner responsible or liable for, and specifically disclaim, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize or portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Submission of a Contest entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify the recipe and essay included with the entry in any way, in commerce and in any and all media worldwide, without limitation and without consideration to the entrant. Submission of any entry further constitutes the entrant's (or his/her parent's or guardian's) consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including, without limitation, all intellectual property rights. Each entrant must be the sole and rightful owner of the recipe and creator of the essay submitted in the Contest. Essays and recipes may not have won previous awards, may not have been published previously and must not infringe upon any other person's rights. Acceptance of a Contest prize will further constitute and signify a winner's agreement and consent (or that of parent or legal guardian if winner is a minor) that the Sponsor and/or Sponsor's assignee may use the winner's name, photograph, images, likeness, voice, signature, biographical information, essay, recipe and/or any other intellectual property materials created or submitted as part of the Contest, in addition to any and all materials created during public relations activities related to the Contest (collectively "Publicity Materials") for purposes of advertising, publicity and trade related to Sponsor's products and/or services, in all media worldwide (including Sponsor's web sites), without further compensation, except where prohibited. Winners' statements may be used in whole or in part and may be paraphrased, amplified, shortened, and/or put into conversational form to meet the requirements of copy, layout and/or script, provided their general sense is not changed. All Publicity Materials developed or used will be Sponsor's property and will be works "made for hire" and each winner will retain no ownership rights whatsoever in or to said works. If said Publicity Materials are not considered works "made for hire," each winner hereby assigns all said works to Sponsor. Winner and Finalists are solely responsible for any federal, state or local taxes on prizes. All federal, state, and local laws and regulations apply. Void outside the 50 United States and D.C. and where prohibited. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of the Contest, including without limitation, barring and disqualifying entrants who do not comply with these Official Rules. If, for any reason, the Contest is not capable of running as planned by any cause which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend the Contest and determine winners from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. In case of cancellation, a winning recipe and essay will be chosen from all eligible entries received prior to the date of cancellation and if circumstances permit. If due to any technical, production or other error, more prizes are claimed or awarded than are described in the Official Rules at any prize level, the number of prizes identified in the Official Rules will be awarded in a random drawing from all such prize claims received. By entering, entrants agree and consent: (a) that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest (excluding, for this purpose any issues or questions concerning the acceptance, possession or use/misuse of the prize or participation in any prize-related activity) (collectively, a "Non-Prize Issue"), will be governed by, and construed in accordance with, the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules, and (b) to the jurisdiction and venue of the federal, state and local courts located in Cleveland, Ohio with respect to any Non-Prize Issue. By entering, entrants agree and consent: (i) that all issues and questions concerning the acceptance, possession or use/misuse of the prize or participation in any prize-related activity (collectively, a "Prize Issue") will be governed by, and construed in accordance with, the laws of State of Florida, without giving effect to any choice of law or conflict of law rules, and (ii) to the jurisdiction and venue of the federal, state and local courts located in Orlando, Florida with respect to any Prize Issue.
LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e mail address submitted at the time of entry. "Authorized account holder" is deemed as the natural person who is assigned to an e mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e mail addresses for the domain associated with the submitted e mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web Site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Web Site users, or by any equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Sponsor's Web Site. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Contest or the Sponsor's Web Site, may be acting in violation of the terms of the Sponsor's Web Site or these Official Rules or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any Web Site or undermine the legitimate operation of the Contest is unlawful and subject to legal action by Sponsor or its agents.
IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES OR RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS ACCESS TO OR USE OF THE WEB SITE OR DOWNLOADING FROM AND OR PRINTING MATERIAL DOWNLOADED FROM SAID WEBSITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
